1. INTRODUCTION & CONTRACTUAL FRAMEWORK

These Terms and Conditions of Sale and Use (“Terms”) govern all purchases, access, downloads, and usage of digital assets, 3D printing models, software plugins, CAD files, and related services provided through the website https://panomic3d.com (“Website” or “Platform”).

The Website is operated by PLASTIC SPIRAL LIMITED (“Company”, “Panomic3D”, “we”, “us”, or “our”), a company incorporated in England and Wales under Company Registration Number 12447936, with its registered office at 13 Hungerford Rd, Stourbridge, West Midlands, DY8 3AA, United Kingdom.

By placing an order, downloading any file, registering an account, or otherwise accessing the Platform, you (“Customer”, “User”, or “you”) enter into a legally binding contract with PLASTIC SPIRAL LIMITED governed by the laws of England and Wales. If you do not agree to these Terms, you must immediately cease using the Platform and refrain from purchasing or downloading any digital content.

2. DIGITAL CONTENT CHARACTERISTICS, PRICES & DELIVERY

All products sold on Panomic3D consist exclusively of non-tangible, downloadable digital content (including 3D printing models in .STL, .OBJ, .3MF, .CAD formats, or software plugins). No physical goods, hardware, or 3D prints are shipped unless explicitly stated in a specific custom agreement.

Delivery is fulfilled immediately upon successful payment authorization via direct download links provided on the order confirmation screen and dispatched to the email address supplied during checkout. It is the Customer’s sole responsibility to ensure that a valid, accurate email address is provided and that hardware/software capabilities meet the technical specifications required to open and slice the 3D files.

Prices may be displayed on the Website in multiple currencies for customer convenience (including GBP £, USD $, EUR €, CAD $, and others). However, final settlement transactions are conducted in Great British Pounds (GBP £) or the currency authorized at checkout. If your card account is denominated in a different currency, your card issuer may apply currency conversion rates and cross-border fees for which PLASTIC SPIRAL LIMITED is not responsible.

3. CANCELLATION RIGHTS & MANDATORY STATUTORY WAIVER (CCR 2013)

3.1 Statutory 14-Day Right of Cancellation Overview

Under Regulation 29 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, UK consumers generally have a 14-day statutory right to cancel distance contracts without giving any reason.

3.2 Express Waiver for Immediate Digital Delivery (Regulation 37)

Under Regulation 37(1) of the CCRs 2013, the statutory right of cancellation for digital content that is not supplied on a tangible medium is forfeited if performance (downloading or accessing the file) begins with the consumer’s prior express consent and acknowledgment.

By selecting ‘Place Order’ or ‘Pay Now’, you expressly consent to PLASTIC SPIRAL LIMITED providing immediate access to your purchased digital files, and you explicitly acknowledge that by commencing download, you waive and lose your statutory 14-day right to cancel this contract under the Consumer Contracts Regulations 2013.

4. DEFECTIVE DIGITAL CONTENT & REFUND POLICY (CRA 2015)

4.1 Statutory Quality Standards

Under the Consumer Rights Act 2015, all digital content supplied by PLASTIC SPIRAL LIMITED must be:

• a) As described on the product page (including polygon count, dimensions, format, and render representations).
• b) Fit for purpose (capable of being parsed by standard 3D slicing software such as Cura, PrusaSlicer, or Bambu Studio).
• c) Of satisfactory quality (free from corrupt mesh data, non-manifold geometry, or broken links).

4.2 Remedial Procedure for Defective Digital Content

If a downloaded file is corrupted, incomplete, manifold-broken, or fails to conform to description:

• The Customer must notify Customer Support at support@panomic3d.com with order details and error description.
• PLASTIC SPIRAL LIMITED will inspect and attempt to repair, replace, or re-deliver a fully functional updated file within 48 hours of notification.
• If we are unable to repair or replace the defective digital file within 48 hours, the Customer is entitled to a full 100% refund of the purchase price.

4.3 Non-Refundable Circumstances

Refunds will NOT be issued under the following circumstances:

• Change of mind or accidental purchase after the file download has commenced.
• Customer’s failure to verify software compatibility or printer hardware limitations prior to purchase.
• Issues arising from third-party 3D printer calibration, slicer settings, or material defects.

4.4 Refund Processing Timelines

Approved refunds are processed within 3 to 5 business days back to the original credit card or payment method used during checkout. Depending on your issuing bank, statement posting may take 5 to 10 business days.

5. INTELLECTUAL PROPERTY & LICENSE AGREEMENT

5.1 License Scope

Upon successful payment, PLASTIC SPIRAL LIMITED grants you a revocable, non-exclusive, non-transferable, worldwide license to download and store the digital file solely for personal, non-commercial 3D printing and prototyping purposes.

5.2 Prohibited Exploitation

You are strictly prohibited from:

• a) Re-selling, sub-licensing, sharing, distributing, or uploading the raw digital files (.STL, .OBJ, .CAD, etc.) to any website, torrent, or repository.
• b) Modifying or creating derivative 3D file works for the purpose of reselling digital files.
• c) Claiming original authorship or intellectual property ownership of the digital assets.

6. INTELLECTUAL PROPERTY COMPLIANCE & TAKEDOWN

6.1 Brand Protection & Anti-Counterfeiting Rules

PLASTIC SPIRAL LIMITED maintains zero tolerance for counterfeit digital content, copyright infringement, or unauthorized trademark usage.

6.2 Restricted Assets Policy

The Platform strictly prohibits listings for operational functional firearm components, dangerous regulated weapon blueprints, or illegal printable items. Any such listings detected will be removed immediately.

6.3 IP Notice and Takedown Procedure

If you are a copyright or trademark owner (or authorized agent) and believe that any 3D model hosted on Panomic3D infringes your intellectual property rights, please submit an official Notice of Infringement to support@panomic3d.com containing:

• Identification of the copyrighted work or trademark claimed to be infringed.
• Direct URL link and exact product listing title on Panomic3D.
• Your legal contact information (full name, company name, email address, physical address).
• A statement that you have a good faith belief that the disputed use is not authorized by the IP owner.

Upon receipt of a valid notice, PLASTIC SPIRAL LIMITED will review and remove or disable access to the infringing material within 24 to 48 hours.

7. CUSTOMER SUPPORT, COMPLAINTS & DISPUTE RESOLUTION

7.1 Customer Service Contact

For technical assistance, billing inquiries, or order questions, Customer Support is accessible via support@panomic3d.com. We endeavor to respond to all inquiries within 24 to 48 hours (Monday through Friday).

7.2 Pre-Dispute Contact Requirement

In accordance with card scheme guidelines, Customers are strongly encouraged to contact PLASTIC SPIRAL LIMITED Customer Support directly to resolve any order issue, download difficulty, or refund request prior to initiating a chargeback dispute with their card issuing bank. Most issues can be resolved rapidly within 24 hours.

7.3 Formal Complaints Procedure

If a complaint cannot be resolved informally, formal complaints should be submitted in writing to support@panomic3d.com titled ‘FORMAL COMPLAINT’. We will acknowledge receipt within 3 business days and provide a final written response within 14 days.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by UK law, PLASTIC SPIRAL LIMITED shall not be liable for direct, indirect, incidental, or consequential damages resulting from the use or inability to use downloaded 3D files, including but not limited to 3D printer hardware damage, filament material loss, or print failure.

Nothing in these Terms excludes or limits PLASTIC SPIRAL LIMITED’s liability for death or personal injury resulting from negligence, fraud, or fraudulent misrepresentation, or any statutory liability that cannot be excluded under the Consumer Rights Act 2015.

9. GOVERNING LAW & JURISDICTION

These Terms, their subject matter, and their formation are governed by and construed in accordance with the laws of England and Wales.

Any legal dispute, claim, or proceeding arising out of or in connection with these Terms or the purchase of digital content shall be subject to the exclusive jurisdiction of the courts of England and Wales (or, for consumers residing in Scotland or Northern Ireland, the respective jurisdiction of their resident courts).
